Konpe is a free to play contest of skill operated by Cuoroom Inc. ("Konpe," "we," "us," or "our"). Players predict match scores, tournament brackets, and champions across live sports tournaments, and a live leaderboard ranks all participants by points earned through accurate predictions. These Terms of Service ("Terms") govern your access to and use of Konpe. By creating an account or using Konpe, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Konpe.
You must be at least 18 years old to use Konpe, enter contests, or claim prizes. By creating an account you confirm that you meet the applicable age requirement in your jurisdiction, and where applicable law requires a higher minimum age, that higher age applies to you. Accounts held by users under 18 are not eligible to win, claim, or redeem any prize. Konpe is void where prohibited by law. Eligibility for prizes is also governed by the Official Rules, including tax status rules that may affect how a prize is delivered.
You may sign in using a supported identity provider. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to provide accurate information, to keep it current, and to notify us promptly at info@cuoroom.com if you believe your account has been compromised. You may not share, sell, or transfer your account, and you may not maintain more than one account.
You agree not to: (a) use automated tools, scripts, or bots to submit predictions or access the service; (b) attempt to manipulate, cheat, or reverse engineer the leaderboard or scoring; (c) interfere with or disrupt the platform, its security, or its infrastructure; (d) use the service for any unlawful purpose; (e) impersonate any person or entity or misrepresent your affiliation; (f) collect or harvest data about other users; or (g) submit content that is unlawful, infringing, harassing, or offensive. We may disqualify, suspend, or remove any participant or content found in violation of these Terms, at our discretion.
Konpe is free to play. No purchase, payment, or any form of consideration is necessary to participate or to be eligible for any prize, and providing consideration would not improve your chances of winning. Konpe is a contest of skill, not a game of chance, and is not a lottery, sweepstakes requiring a purchase, gambling, or wagering of any kind.
Prizes vary by contest and are sponsor funded giveaways with no purchase necessary. A contest may award cash, gift cards, or physical products, provided by Cuoroom Inc. or its designated sponsor, distributed by leaderboard standing at the close of the applicable tournament. Cash is paid to a verified PayPal account in a supported country (at launch: United States, Spain, and Mexico). Gift cards are delivered by email and physical products require a valid shipping address. Published prize values are stated before any tax we are required to withhold. The complete prize table, eligibility, delivery, claim, and the US and foreign winner tax rules are set out in the Official Rules, which are incorporated into these Terms by reference. If these Terms and the Official Rules conflict on a prize matter, the Official Rules control. Cuoroom Inc. reserves the right to modify, suspend, or discontinue prize offerings at any time, except where prohibited by law.
Winners are solely responsible for all federal, state, local, and foreign taxes on prizes, and for any filings related to them. Where we are required by law to withhold tax or to collect a tax form (for example a Form W-9 from a US person, or a Form W-8BEN from a person who is not a US person) before releasing a prize, you agree to provide accurate and complete information on request. A prize may be reduced by required withholding, and for a prize that is not cash you may be required to prepay any withholding before the prize is released. Details are in the Official Rules. Nothing here is tax advice; consult your own advisor.
Konpe and all of its content, features, software, designs, text, graphics, and marks are owned by Cuoroom Inc. or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, nonexclusive, nontransferable, revocable license to access and use Konpe for your own noncommercial use. You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the service, except as expressly permitted by law. All rights not expressly granted are reserved.
You are responsible for any content you submit, including your display name and any information you provide. You grant Cuoroom Inc. a worldwide, royalty free, nonexclusive license to use, host, store, display, and reproduce that content for the purpose of operating and improving Konpe. You represent that you have the rights to the content you submit and that it does not violate any law or third party right. We may remove content that violates these Terms at any time.
By accepting a prize, you consent to Cuoroom Inc.'s use of your name, display name, general location, and likeness for promotional purposes in connection with the contest, without additional compensation, except where prohibited by law.
The Konpe service is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant that the service will be uninterrupted, timely, secure, error free, or that results, scores, or data feeds will be accurate or available. Match data may be delayed or corrected, and scoring is final as determined under the Official Rules.
To the fullest extent permitted by applicable law, Cuoroom Inc. and its officers, directors, employees, agents, and sponsors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of Konpe, even if advised of the possibility of such damages. Our total cumulative liability for all claims relating to Konpe shall not exceed one hundred US dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify, defend, and hold harmless Cuoroom Inc. and its officers, directors, employees, agents, and sponsors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of Konpe, your content, your violation of these Terms, or your violation of any law or third party right.
Before filing any claim, you agree to first contact us at info@cuoroom.com and attempt to resolve the dispute informally for at least 30 days. Any dispute that is not resolved informally shall be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction. To the extent permitted by law, you and Cuoroom Inc. waive any right to a jury trial, and you agree that claims may be brought only in an individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding. Any claim must be filed within one (1) year after it arises, or it is permanently barred, except where applicable law requires a longer period.
We may suspend or terminate your access to Konpe at any time, with or without notice, if we believe you have violated these Terms or the Official Rules, engaged in fraud or abuse, or created risk or legal exposure for us. You may stop using Konpe at any time and may request account deletion as described in our Privacy Policy. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution.
You represent that you are not located in, and are not a resident of or owned or controlled by a party in, any country or by any person subject to United States sanctions administered by the Office of Foreign Assets Control (OFAC), and that you are not on any US government restricted party list. We do not award or deliver prizes where doing so would violate applicable sanctions or export control laws.
We may update these Terms from time to time. Material changes will be noted on this page with an updated date. Your continued use of Konpe after changes are posted constitutes your acceptance of the revised Terms. By using Konpe you consent to receive communications from us electronically, including service notices, prize and eligibility notices, and account messages, at the email address on your account. You agree that electronic notices satisfy any legal requirement that a communication be in writing.
These Terms and the Official Rules are the entire agreement between you and Cuoroom Inc. regarding Konpe and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions stay in effect and the unenforceable provision is modified to the minimum extent necessary. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent, and we may assign them to an affiliate or successor. We are not liable for any failure or delay caused by events beyond our reasonable control. These Terms do not create any agency, partnership, or employment relationship between you and Cuoroom Inc. These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law rules.
